Internet & online related offences are complex matters. Zach has successfully represented many individuals under suspicion or arrested by police agencies for their alleged involvement in computer and internet-related crimes.
With the escalating use of computers in our personal and professional lives, and the dominance of the internet in the way we do business, the Criminal Code of Canada includes violations for those who might use this changing technology in a way which violates the law. Many crimes can be committed solely on an electronic platform. Crimes involving the use of computers and the internet, are also sometimes referred to as “Cyber Crime” or violations of “Cyber Law”.
Some common examples of charges stemming from the Internet or computers include:
Internet “luring.”
Criminal harassment (sometimes called “cyber-stalking”) and uttering threats.
Extortion (“blackmail”).
Fraud, forgery, impersonation, and identity theft.
Copyright infringement and other intellectual property crimes.
Making, accessing, or distributing videos of minors or other obscene materials.
There are also some specific crimes that directly relate to computers and computer networks, such as “unauthorized access to a computer system” and “mischief to data.” These include what most people would think of as “hacking.”
Records from the Internet and electronics can also create evidence that can be used in almost any kind of investigation. For example, text messages on a cell phone could help police prove that a person was selling drugs. Or a phone company might record which cell phone tower was used to make a phone call, which could help prove that someone was nearby when a murder was committed. Or a person’s hard drive could contain a copy of a video that shows a person being assaulted. There are a wide variety of cases or situations where this can apply.
